In re the marriage of Jayne CHERKASKY, Petitioner–Appellant, v. Alan CHERKASKY, Respondent–Respondent.

Id. The supreme court held that not only had the inheritance constituted a substantial change in circumstances, but that the circuit court erred in setting maintenance because it considered the income on the inheritance, but not the possibility that Vivian might be required to utilize some of the corpus as well. The court observed, “We have repeatedly stated that, where a wife has inherited a substantial estate after divorce, she may be obliged to use some or all of the principal of her inheritance if she wishes to maintain a particular standard of living.” Id. at 461, 241 N.W.2d 593. Id. at 197–98, 327 N.W.2d 674.
