ORDER OF DISMISSAL WITH PREJUDICE


On March 25, 2003, beginning at 3:30 p.m., the Court conducted a hearing on the motion for summary judgment filed by Defendant Autoliv ASP, Inc. ("Defendant" or "Autoliv"). Russell Monahan appeared and presented argument on behalf of Plaintiff Wakely Chee ("Plaintiff" or "Chee"). Janet Hugie Smith and Richard Shimabukuro appeared and represented Defendant Autoliv.

The Court had previously received and considered memoranda from both parties addressing the motion for summary judgment. After hearing argument on behalf of both parties, the Court issued its ruling from the bench. For the reasons explained by the Court at the conclusion of the hearing on March 25, 2003, the Court granted Autoliv's motion for summary judgment on Plaintiff Wakely Chee's claim under the Americans with Disabilities Act. The Court therefore ordered the entry of judgment in favor of Defendant Autoliv. The clerk of the court is directed to close this case.
