By Notice dated May 24, 2023, this case is calendared for trial on the Court's October 23, 2023, San Diego, California trial calendar.

On October 2, 2023, respondent filed a Motion to Dismiss for Lack of Prosecution. In his motion respondent asserts that petitioner has not been responsive to respondent's attempts to communicate in order to resolve or narrow the issues.

Premises considered, it is

ORDERED that petitioner shall, on or before October 17, 2023, file an objection, if any, to respondent's above-referenced motion. Any objection filed shall state with specificity the nature of the objection. Petitioner is advised that failure to communicate and/or failure to appear can result in dismissal.
