ORDER

Patrick J. Urda, Judge.

On January 23, 2023, the Court issued an Order to Show Cause directing the parties to file a response as to why the Court should not dismiss this case for lack of jurisdiction on the ground that the petition was not timely filed. The Commissioner filed his response to our Order but we did not hear from petitioner Timothy R. Chatman. Therefore, the Court set this Order to Show Cause for hearing.

This case was called from the calendar for the trial session of the Court at Houston, Texas on March 27, 2023. Both parties appeared and were heard. Upon due consideration, and for cause more fully appearing in the transcript of the proceeding, it is

ORDERED that the Court's Order to Show Cause served January 23, 2023, is hereby discharged. It is further

ORDERED that jurisdiction is retained by the undersigned. It is further

ORDERED that, on or before May 26, 2023, the parties shall file a joint status report apprising the Court of the then-present status of this case.
