DECISION & ORDER ON MOTION
Motion by appellant to for an extension of time to perfect an appeal from a judgment of the Civil Court of the City of New York, Kings County, entered August 1, 2022, and for leave to prosecute the appeal on the original record. Cross-motion by respondent to dismiss the appeal as untimely.
Upon the papers filed in support of the motion and the papers having been filed in opposition thereto, it is
ORDERED that the cross-motion to dismiss is denied; and it is further, ORDERED that the motion for an extension of time to perfect the appeal is granted and the appeal shall be perfected on or before June 24, 2024; and it is further, ORDERED that in the event the appeal is not perfected by June 24, 2024, the court, on its own motion, may dismiss the appeal, or respondent may move, on three days' notice, to dismiss the appeal, and may serve such application upon appellant in person; and it is further, ORDERED that the application to prosecute the appeal on the original record is granted and appellant may prosecute the appeal on the original record; and it is further, ORDERED that appellant shall serve a copy of this order upon the Clerk of the Civil Court of the Civil Court of the City of New York, Kings County, within 10 days of the date of this order.
