ORDER
The Court has been advised that a magistrate judge has recommended that the $10.8 million default judgment entered against Pacific Electric Wire Cable Co., Ltd. ("PEWC") in the United States District Court for the District of Delaware be set aside. The Chase Manhattan Bank v. Iridium Africa Corp., et al., No. 00-564 (RRM). Objections to that recommendation are currently pending before the district judge assigned to the case. During a telephone conference with counsel on April 26, 2002, this Court indicated that it was inclined to deny plaintiff's motion for contempt against PUSA and Paul J. Weber without prejudice, pending a final ruling on the motion to set aside the default judgment. However, the Court allowed the parties additional time to determine whether such a disposition of the motion would affect any substantive rights.
Accordingly, plaintiffs and defendants shall submit letter briefs by May 3, 2002, setting forth their respective positions as to whether plaintiff's motion for contempt against PUSA and Paul J. Weber should be denied without prejudice pending a final ruling on the motion to set aside default judgment. Alternatively, the parties may submit an agreed order denying this motion without prejudice by May 3, 2002.
