Appeal from an order of the Civil Court of the City of New York, Kings County (Noach Dear, J.), entered January 4, 2012. The order, insofar as appealed from, granted the branch of plaintiff's motion seeking to dismiss defendant's counterclaim.
Present: WESTON, J.P., PESCE and RIOS, JJ.

ORDERED that the order, insofar as appealed from, is affirmed, without costs.

Upon a review of the record, we find that defendant's counterclaim was properly dismissed. Accordingly, the order, insofar as appealed from, is affirmed.
