Present — Glennon, J.P., Dore, Callahan, Van Voorhis and Shientag, JJ.; Callahan and Shientag, JJ., dissent on the authority of Banca Commerciale Italiana Trust Co. v. Clarkson ( 274 N.Y. 69). [See post, p. 922.]


Determination of the Appellate Term, affirming the order of the City Court, affirmed, with costs to the defendant-respondent. No clause authorizing the giving of a loan receipt is contained in the insurance policy ( Slater Trucking Co. v. Maus, 273 App. Div. 139; Sosnow, Kranz Simcoe v. Storatti Corp., 269 App. Div. 122, 123, 126). Plaintiff is protected by the procedure adopted by the Appellate Term of a separate trial of the issue concerning the real party in interest.
