In Re: James Chargois, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 659196. BEFORE: McDONALD, McCLENDON AND HOLDRIDGE, JJ.
WRIT NOT CONSIDERED. Relator, James Chargois, seeks review of the trial court's January 31, 2018 judgment that dismissed relator's petition for habeas corpus for failing to state a cause of action. To seek supervisory review of a judgment, a party must file a notice of intent to seek supervisory review with a return date order with the trial court. See Rule 4-2, Uniform Rules of Louisiana Courts of Appeal. A stamped copy of the notice of intent filed with the trial court and a copy of the signed return date order must be submitted with the writ application. See Rule 4-5(C)(11), Uniform Rules of Louisiana Courts of Appeal. The writ application does not comply with the above cited rules.
Furthermore, the writ application does not contain relator's notarized affidavit verifying the allegations of the application and certifying that a copy of the writ application was delivered or mailed to the respondent judge and to opposing counsel, as required by Rule 4-5(A) of the Uniform Rules of Louisiana Courts of Appeal.
Supplementation of this writ application and/or an application for rehearing will not be considered. Rules 4-9 and 2-18.7, Uniform Rules of Louisiana Courts of Appeal.
