Opinion filed June 17, 2009. DO NOT PUBLISH. TEX. R. APP. P. 47.

On Appeal from the 194th Judicial District Court Dallas County, Texas, Trial Court Cause No. F05-73581-M.

Before Justices WRIGHT, BRIDGES, and FRANCIS.

MEMORANDUM OPINION

Thomas G. Charalambopoulos was convicted of aggravated assault. Punishment was assessed at ten year's imprisonment, probated for ten years, and a $10,000 fine. We adopted the trial court's finding that appellant no longer desires to pursue the appeal, and submitted the appeal without briefs. See Tex. R. App. P. 38.8(b)(4). Absent briefs, no issues are before us. Finding no fundamental error, we affirm the trial court's judgment.
