Opinion

Docket No. 8829.

October 31, 1932.

APPLICATION for a Writ of Prohibition to restrain the Superior Court of Alameda County, and John J. Allen, Judge thereof, from acting further in a proceeding in mandamus to compel the certification of a recall petition. Writ denied.

C. Stanley Wood, City Attorney, and Hilton J. Melby, Chief Deputy City Attorney, for Petitioner.

THE COURT.

[1] The petition for a writ of prohibition is denied. Such denial, however, should not be interpreted as a ruling of this court upon the sufficiency of the petition for a writ of mandate filed in the superior court.
