Judgment and order reversed and new trial granted, with costs to appellant to abide event, upon the ground that the plaintiff failed to prove by the weight of the evidence that garbage was spilled upon the walk or that she was in the exercise of due care. All concurred, except Kruse, P.J., and Foote, J., who dissented.
