This 27th day of March 2017, the Court has carefully considered the parties' briefs and the appellant's post-briefing motion to raise the constitutional issue of state-created danger for the first time on appeal. We conclude that the motion should be denied. We further conclude that the judgment of the Superior Court should be affirmed on the basis of its June 28, 2016 opinion.

2016 WL 3640260 (Del. Supr. Ct. June 28, 2016).

NOW, THEREFORE, IT IS ORDERED that the appellant's post-briefing motion is DENIED and the judgment of the Superior Court is AFFIRMED.
