ORDER ACCEPTING FINDINGS AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE

ED KINKEADE, UNITED STATES DISTRICT JUDGE.

After making an independent review of the pleadings, files and records in this case, and the Findings, Conclusions, and Recommendation of the United States Magistrate Judge dated November 3, 2023, the Court finds that the Findings and Recommendation of the Magistrate Judge are correct and they are accepted as the Findings, Conclusions, and Recommendation of the Court.

IT IS, THEREFORE, ORDERED that the Findings, Conclusions, and Recommendation of the United States Magistrate Judge are accepted. Plaintiff's Motion for Default Judgment [ECF No. 17] is DENIED without prejudice to refile. Chanel has 30 days after entry of this order to cure the defects regarding service of process on Defendant Christian Salvatore NY Corp.

SO ORDERED.
