DECISION & ORDER ON MOTION

Application by the respondent pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief on an appeal from an order of the Supreme Court, Dutchess County, dated June 14, 2012.

Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that on the Court's own motion the application and the appeal in the above-entitled action are transferred to the Appellate Division, First Department, for hearing and determination; and it is further,

ORDERED that all further proceedings in connection with the application and the appeal shall be conducted pursuant to the rules of the Appellate Division, First Department.
