Cernudo v. Schmidt

Appellate Division of the Supreme Court of New York, First Department
Jan 1, 1930
228 App. Div. 689 (N.Y. App. Div. 1930)

Opinion

January, 1930.

Present — Dowling, P.J., Merrell, Martin, O'Malley and Proskauer, JJ.

Judgments reversed and a new trial ordered, with costs to the appellants to abide the event, on the ground that the verdict is against the weight of the evidence and that a dispassionate consideration of the evidence by the jury was rendered impossible by the colloquies occurring during the trial.
