Ceramic Tile & Marble v. Poma

District Court of Appeal of Florida, Fourth District
Aug 9, 2000
766 So. 2d 392 (Fla. Dist. Ct. App. 2000)

Opinion

No. 4D99-3911

Opinion filed August 9, 2000 Rehearing Denied September 22, 2000 JULY TERM 2000

Appeal from the Circuit Court for the Fifteenth Judicial Circuit, Palm Beach County; Kathleen J. Kroll, Judge; L.T. Case No. CL 90-2899 AG.

Luther Martin Taylor, J.D., Palm Beach Gardens, for appellant.

C. Brooks Ricca, Jr. of C. Brooks Ricca, Jr. Associates, P.A., West Palm Beach, for appellee.

We affirm the trial court's order dismissing count V of appellant's amended complaint. The count attempted to set up a claim under Chapter 726, Florida Statutes, a statute which, even if it were in effect at the time of the closing, would not apply to a transfer of this type of property.

AFFIRMED.

KLEIN, GROSS, JJ., and FINE, EDWARD H., Associate Judge, concur.
