  1. Cent. Eastside Indus. Council v. City of Portland

    905 P.2d 265 (Or. Ct. App. 1995)

DEITS, P.J. In Central Eastside Industrial Council v. City of Portland, 128 Or. App. 148, 875 P.2d 482 (1994), we reversed and remanded LUBA's decision that it lacked jurisdiction over petitioners' appeal from an action of the City of Portland. On remand, LUBA held that it had jurisdiction and remanded the matter to the city.

  2. Knee Deep Cattle Co. v. Lane County

    890 P.2d 449 (Or. Ct. App. 1995)   Cited 1 times

We hold that LUBA had jurisdiction and we affirm on the cross-petition. Our conclusion finds support in Central Eastside Industrial Council v. City of Portland, 128 Or. App. 148, 875 P.2d 482 (1994), and Schreiner's Garden v. DEQ, 71 Or. App. 381, 692 P.2d 660 (1984). We emphasize, however, that the bases for our decision are the current statutes and regulations and other factors discussed in the text, and the cases cited here are relevant only by analogy.
