ORDER


The defendants' motion for summary judgment dismissing the complaint is granted and the plaintiff's motion for leave to amend is denied, both substantially for the reasons set forth in the thorough and careful report and recommendation of Magistrate Judge Theodore H. Katz to which no objection has been filed. The Clerk shall enter judgment and close the case.

SO ORDERED.
