MEMORANDUM OPINION


We withdraw our opinion of October 17, 2006 and vacate our judgment of that date. This is now the opinion of the Court.

On October 25, 2006, the parties filed an agreed motion requesting that we set aside the trial court's judgment and remand the case to the trial court. Accordingly, the Court GRANTS the motion. We VACATE the trial court's judgment without regard to the merits and REMAND the case to the trial court for further proceedings. Tex.R.App.P. 42.1(a)(2) 43.2(d). We ORDER the parties to bear their own costs of appeal.
