Mark Thomas Cave, Appellant v. Kensington Apartments Austin, LP d/b/a Kensington Apartments, Appellee

FROM THE COUNTY COURT AT LAW NO. 1 OF TRAVIS COUNTY, NO. C-1-CV-24-001228, THE HONORABLE TODD T. WONG, JUDGE PRESIDING

Before Byrne, Chief Justice, Triana and Kelly Justices.

ORDER

PER CURIAM

On July 17, 2024, appellant Mark Thomas Cave filed an "Emergency Motion to Stay or Recall Writ of Possession," seeking a stay from the execution of a writ of possession. On July 18, 2024, the Court requested that appellee Kensington Apartments Austin, LP d/b/a Kensington Apartments file a response to the motion on or before July 22, 2024. Appellee's counsel filed a vacation notice with the Court indicating that she would be unavailable from July 22, 2024, until August 7, 2024. To date, no response has been filed by appellee.

To preserve the status quo pending the Court's receipt of appellee's response, we temporarily order that execution of the writ of possession is stayed. The Court again requests that appellee file a response to the emergency motion on or before August 22, 2024.

It is ordered.
