DECISION AND ORDER ON MOTION

Motion for extension of time to file and serve brief of respondent Crossroads Ventures LLC.

Motion by respondent Department of Environmental Conservation to supplement the record on appeal and its appendix.

Upon the papers filed in support of the motions and the papers filed in response and in opposition thereto, it is

ORDERED that the motion for an extension of time to file and serve the brief of respondent Crossroads Ventures LLC is granted, without costs, and the brief is deemed timely filed and served, and it is further

ORDERED that the motion to supplement the record on appeal and the appendix of respondent Department of Environmental Conservation is granted, without costs, and the Department of Environmental Conservation is directed to file and serve a supplemental record on appeal and a supplemental appendix, on or before October 20, 2017, which shall contain petitioners' memorandum of law dated February 11, 2016 and petitioners' reply memorandum of law dated July 13, 2016.
