ORDER


After due and proper consideration of all portions of this file deemed relevant to the issues raised, and there having been no objections filed, the recommendation of the Magistrate Judge made under 28 U.S.C. § 626(b)(1)(B) and dated July 28, 2010 is ADOPTED as the opinion of this Court and the decision of the Commissioner of Social Security denying plaintiff's benefits is REVERSED and REMANDED.

This remand makes the plaintiff a prevailing party for purposes of the Equal Access to Justice Act, 28 U.S.C. § 2412, and terminates this Court's jurisdiction over this matter.
