Appeal from Supreme Court.


The action is one for breach of contract of employment. A previous trial before the court and jury resulted in a disagreement. There are issues here which should be determined on a trial. Order affirmed, with ten dollars costs and disbursements. Hill, P.J., Heffernan, Schenck and Foster, JJ., concur; Bliss, J., dissents.
