No. 05-06-01686-CV (Tex. App. May. 2, 2008)

Opinion

No. 05-06-01686-CV

Opinion issued May 2, 2008.

On Appeal from the 14th Judicial District Court, Dallas County, Texas, Trial Court Cause No. 03-00352.

Before Justices MORRIS, WHITTINGTON, and O'NEILL.

MEMORANDUM OPINION

The clerk's record has never been filed in this appeal. On March 14, 2008, we ordered the Dallas County District Clerk to file either the clerk's record or written verification that no payment had been received. The order further provided that if we received verification of non-payment, we would dismiss the appeal. On April 7, 2008, we received from the clerk a copy of a letter from appellant's counsel stating the parties had settled and asking that the clerk discontinue preparation of the record. Accordingly, we dismiss the appeal for want of prosecution. See Tex. R. App. P. 37.3(b).
