Appellate Division of the Supreme Court of New York, Fourth Department
Jul 1, 1920
193 App. Div. 924 (N.Y. App. Div. 1920)

Opinion

July, 1920.

Judgment and orders affirmed, with costs. All concur, except Kruse, P.J., and Hubbs, J., who dissent upon the ground that the court erred in charging the jury that the defendant owed the deceased a high degree of care and that the deceased was bound to exercise only reasonable care.
