ORDER ACCEPTING MAGISTRATE JUDGE'S INTERIM REPORT AND RECOMMENDATION

PERCY ANDERSON, UNITED STATES DISTRICT JUDGE

Pursuant to 28 U.S.C. § 636, the Court has reviewed the First Amended Complaint, the records and files herein, the Magistrate Judge's Interim Report and Recommendation, and Plaintiff's Objections to the Interim Report and Recommendation. The Court has engaged in a de novo review of those portions of the Interim Report and Recommendation to which objections have been made. The Court accepts the recommendations of the Magistrate Judge.

ACCORDINGLY, IT IS ORDERED:

1. The Interim Report and Recommendation is accepted.

2. The official capacity claims against Defendants Sekhon and Chakrabarty are dismissed with prejudice and without leave to amend.

3. By separate order, the Magistrate Judge will order service by the U.S. Marshal of the summons and First Amended Complaint, on Defendants Sekhon and Chakrabarty in their individual capacities.

4. The Court Clerk shall serve this Order on all counsel or parties of record.
