An appeal having been taken herein from an order of the Family Court, Genesee County, entered in the Office of the Clerk of said Court on May 1, 2012, and petitioner-respondent having moved to strike respondent-appellant's reply brief,

Now, upon reading and filing the affirmation of Durin B. Rogers, Esq., dated February 26, 2013, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that all references to appellate counsel's communication with trial counsel are stricken from the reply brief and will not be considered by the Court.
