Opinion

Case No. 3D02-1271.

Opinion filed March 19, 2003. Rehearing denied May 14, 2003.

An appeal from the Circuit Court for Dade County, Thomas S. Wilson, Jr., Judge. Lower Tribunal No. 01-16202.

Joseph F. Lopez, for appellant.

Hinshaw Culbertson and Gina E. Caruso and Nickolas C. Berry, for appellee.

Before COPE, GERSTEN and WELLS, JJ.

The summary judgment is affirmed on authority of Spector v. Ahrenholz, 107 So.2d 34, 36 (Fla. 3d DCA 1958); see also Mills v. Mills, 112 So.2d 298 (Fla. 1959); Rappaport v. Kalstein, 24 So.2d 301 (Fla. 1946). It is our view that the trial court correctly applied the principles described in those decisions to the case now before us.

Affirmed.
