This cause is before the Court on Plaintiff's Motion for Award of Attorney's Fees and Costs, filed August 16, 2004 (DE 11) and the Report and Recommendation of United States Magistrate Judge Barry S. Seltzer, dated January 7, 2005 (DE 19). The Court has considered the motion, the Report and Recommendation, and the other pertinent portions of the record, and is otherwise advised in the premises.

After careful review of the Report and Recommendation, and noting no objections to the Report and Recommendation have been filed, it is

ORDERED AND ADJUDGED as follows:

1. The Report and Recommendation of the Magistrate Judge, dated January 7, 2005 (DE 19), is hereby APPROVED.

2. Plaintiff's Motion for Award of Attorney's Fees and Costs, filed August 16, 2004 (DE 11), is GRANTED IN PART AND DENIED IN PART. Plaintiff shall be awarded $3,875 in attorney's fees and $215 in costs, for a total award of $4,090.

3. The Court will enter a Judgment for Fees and Costs in favor of Plaintiff by separate order.

4. Any pending motions are DENIED as moot.
