Opinion

Decided December 5, 1930.

This case comes up on appeal from the decree of a sitting Justice dismissing, on the ground that certain proper and necessary persons were not made parties, a bill in equity brought for specific performance of a contract to convey real estate.

The basis of dismissal being as stated, and it clearly appearing that certain persons in interest are not parties to the bill, the entry must be, Appeal dismissed. Decree below affirmed.
