ROBERT CARVER, Appellant, v. THE STATE OF TEXAS, State.

Appeal from the

362nd District Court

of Denton County, Texas

(TC# F-2010-1715-D)

ORDER

Pending before the Court is Appellant's motion to supplement the record with the following items: (1) Lewisville Police Department Lab Request Form, dated 6-17-10; (2) Lewisville Police Department Property/Evidence Report, dated 6-16-10 (report No. 10-06943); (3) memo from the Lewisville Police Department addressing the firing of evidence technicians for misappropriation of evidence; and all of the crime scene photographs taken on June 16, 2010 including those not admitted into evidence at trial. Appellant states that the items were turned over to him as part of discovery. The reporter's record contains a large exhibits volume of the exhibits actually admitted into evidence. The crime scene photographs admitted into evidence and a lab report are already included in the exhibits volume. The remaining items were not admitted into evidence. Appellant's motion to supplement the record is denied.

IT IS SO ORDERED THIS 11TH DAY OF SEPTEMBER, 2013.

PER CURIAM Before McClure, C.J., Rivera and Rodriguez, JJ.
