Zepatrick Lee CARTER, Appellant v. The STATE of Texas, Appellee
From the County Court at Law No. 13, Bexar County, Texas Trial Court No. 573322 Honorable Rosie S. Gonzalez, Judge Presiding
Sitting: Rebeca C. Martinez, Chief Justice Patricia O. Alvarez, Justice Lori I. Valenzuela, Justice
ORDER
LORI I. VALENZUELA, JUSTICE
Appellant's brief was due on October 18, 2021. Appellant is represented on appeal by appointed counsel, Ms. Jessica Gonzalez. On October 19, 2021, Ms. Gonzalez filed a motion for extension of time requesting a 90-day extension to file appellant's brief. The motion recites the following reason for the request, "This extension request is due to current appointed counsel withdrew from case to allow for the Court to appoint appellate counsel. The Court is still processing the request for appointed counsel and the new appointed counsel needs time to review the appellate records and draft the brief to the Court."
In light of the stated reason for Ms. Gonzalez's request for an extension of time, we ABATE this cause to the trial court to consider the (1) withdrawal of Ms. Gonzalez as appellant's appointed counsel and (2) appointment of new counsel on appeal. We further ORDER the trial court to rule on these issues no later than November 4, 2021. A supplemental clerk's record containing the trial court's rulings shall be filed with the clerk of this court no later than November 15, 2021. Appellant's motion for an extension of time is DENIED without prejudice to newly appointed counsel filing a new motion for extension of time. All appellate deadlines are ABATED pending further orders from this court.
