District Court of Appeal of Florida, Second District.
Jan 13, 2015
171 So. 3d 710 (Fla. Dist. Ct. App. 2015)

Opinion

No. 2D14–5939.

01-13-2015

David CARTAGENA, Appellant/Petitioner(s), v. STATE Of Florida, Appellee/Respondent(s).

Opinion

BY ORDER OF THE COURT.

As a petition for belated appeal is not available in a civil proceeding, the petition for belated appeal is dismissed. Relief may be sought in the trial court by motion under Florida Rule of Civil Procedure 1.540(b) to set aside the order where no notice of its entry was provided petitioner, coupled with a request that a new order be entered so that the right of appeal is preserved.

VILLANTI, LaROSE, and MORRIS, JJ., Concur.
