ORDER

Christian N. Weiler Judge

This case is presently calendared for trial on the Court's April 4, 2022, Memphis, Tennessee trial session. On March 4, 2022, respondent filed a motion for continuance of trial which states that petitioner, Donny R. Carruthers, passed away subsequent to the filing of the petition in this case. The motion further states that respondent's counsel is attempting to ascertain whether there is a representative or fiduciary that is currently authorized to act on behalf of the estate of petitioner, deceased.

Upon due consideration and for good cause, it is

ORDERED that respondent's motion for continuance is granted and this case is stricken for trial from the Court's April 4, 2022, Memphis, Tennessee trial session and is continued. It is further

ORDERED that, on or before May 9, 2022, respondent shall file a status report as to whether there is a representative or fiduciary that is currently authorized to act on behalf of the estate of petitioner, deceased. It is further

ORDERED that the undersigned retains jurisdiction over this case.
