ORDERED that the motion to dismiss is denied, without costs, and it is further

ORDERED that the motion to direct appellant to serve respondent's counsel with a copy of the record on appeal is granted, without costs, to the extent that appellant shall serve the record on appeal upon respondent's counsel on or before November 22, 2017, and it is further

ORDERED that the motion for an extension of time to file and serve the brief of respondent is granted, without costs, and the time is extended to January 8, 2018.
