This case is on the calendar of the Court's May 8, 2023 trial session for Des Moines, Iowa. On April 26, 2023, respondent filed a Motion to Dismiss for Lack of Prosecution.
Upon due consideration, it is
ORDERED that respondent's Motion to Dismiss for Lack of Prosecution, is set for hearing at the calendar call of the aforementioned session of the Court, at 10:00 AM (CT) at the U.S. District Court, 123 East Walnut Street, Des Moines, Iowa 50309. Petitioner is advised that failure to comply with the terms of this Order or failure to appear at the hearing on May 8, 2023, may result in the Court granting respondent's motion and entering an order and decision against petitioner. ORDERED that, in addition to regular service, the Clerk of the Court shall serve a copy of this Order at petitioner's secondary address as provided in the certificate of service attached to respondent's motion.
