Upon defendant's statement in open court that his appeal from the judgment has been abandoned, the appeal from the judgment is dismissed, with costs. The order granting a counsel fee to plaintiff's attorneys is modified by directing that the same be allowed and paid to the plaintiff, and as so modified affirmed, without costs. All concurred.
