STIPULATION AND ORDER OF DISMISSAL WITHOUT PREJUDICE


STIPULATION

The above-named parties hereby stipulate, by and through their respective counsel, that the Plaintiffs' claim against Defendant Design Annex, Inc. for outstanding fringe benefits contributions and wage deductions for August through November 2002 shall be dismissed without prejudice and without costs from this lawsuit for the reason that the matter is settled.

ORDER

Based upon the foregoing stipulation, it is hereby

ORDERED that any and all claims against Design Annex, Inc. for fringe benefits contributions and wage deductions for August through November 2002 are hereby dismissed without prejudice and without costs.
