KADAH ALSO KNOWN AS ANN KADAH, DECEASED. LAMISE KADAH CARANO, PETITIONER-APPELLANT; v. RONALD B. KADAH, OBJECTANT-RESPONDENT; DIANNE KADAH TANAKA, APPELLANT.


Respondent having moved to dismiss the appeals taken herein from an order of the Onondaga County Surrogate's Court entered in the Office of the Clerk of said court on April 12, 2011, on the ground that appellants have failed to perfect timely the appeals, and on other grounds,

Now, upon reading and filing the affidavit of Richard L. Weber, Esq., sworn to July 21, 2011, and the notice of motion with proof of service thereof,

It is hereby ORDERED that the motion insofar as it seeks to dismiss the appeals for failure to perfect timely the appeals is granted, and the appeals are dismissed without costs, and

It is further ORDERED that the motion is otherwise dismissed as moot.
