On April 5, 2024, the Commissioner filed a motion to take deposition pursuant to Rule 74(c)(3) seeking to take the deposition of Mr. Charles Darby III. The Commissioner further states that petitioner James P. Carney objects to this motion on various reasons. We will direct Mr. Carney to put his objections in writing. Accordingly, it is

ORDERED that, on or before May 1, 2024, Mr. Carney shall file a response to the Commissioner's motion to take deposition pursuant to Rule 74(c)(3).
