JAMES P. CARNEY, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Patrick J. Urda Judge

On May 27, 2022, petitioner James P. Carney filed a motion for depositions under Rule 81, requesting the Court's assistance of deposing two foreign witnesses, Pieter "Mac" Auwers and Ellen Bucknell. The parties appear to have resolved this motion on their own, based on their representations in a status report of June 21, 2023, as well as the filing of joint stipulations to take the deposition of both witnesses. We thus will deny Mr. Carney's motion as moot. Upon due consideration, it is

ORDERED that Mr. Carney's motion for depositions under Rule 81 is denied as moot. It is further

ORDERED that, on or before August 31, 2023, the parties shall file a joint status report as to the then-present status of this case.
