FINDINGS, CONCLUSIONS AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE

Plaintiff Carla R.K. filed this action seeking judicial review of an unfavorable decision of the Commissioner of Social Security under 42 U.S.C. § 405(g). Dkt. No. 1. Under Special Order No. 3-251 of this Court, this case was automatically referred for the determination of non-dispositive motions and the issuance of findings, conclusions, and recommendation of dispositive matters.

After the Commissioner filed its answer and Plaintiff filed her opening brief, the Commissioner filed an Unopposed Motion to Remand under the fourth sentence of Section 405(g). Dkt. No.15. The undersigned then entered Findings, Conclusions, and a Recommendation that the case be reversed and remanded to the Commissioner, Dkt. No. 16, and United States District Judge James Wesley Hendrix accepted that recommendation, reversed the decision of the ALJ, and remanded the case to the Commissioner. Dkt. No. 17.

Plaintiff later filed her unopposed Motion for Attorney Fees Under the Equal Access to Justice Act, which is now before the Court. Dkt. No. 19. Because the Motion has not been specifically referred to the undersigned for resolution, the undersigned submits these Findings, Conclusions and Recommendation.

Through her Motion, Plaintiff asserts that attorney fees are justified because she is the prevailing party, and the Social Security Administration's position was not substantially justified. Dkt. No. 19 at 1. Plaintiff seeks recovery of attorney fees at an hourly rate of $205.00 for 33.00 hours of attorney services expended in 2022, for a total of $6,765.00 in attorney fees. Dkt. No. 19-1 at 3-4.

The Commissioner filed a response to the Motion confirming there was no objection to the award of attorney fees sought here, but noting that the fee “should be made payable to Plaintiff and sent to Plaintiff's counsel.” Dkt. No. 20 at 1. Plaintiff did not file a reply.

The undersigned has independently determined that the hourly rate and the number of hours sought by Plaintiff are reasonable. Having considered the Motion, the undersigned Recommends that Plaintiff's Motion be granted and that she be awarded $6,765.00 in attorney fees made payable to Plaintiff in care of her attorney.

RIGHT TO OBJECT

A copy of these findings, conclusions, and recommendation shall be served on all parties in the manner provided by law. Any party who objects to any part of these findings, conclusions, and recommendation must file specific written objections within 14 days after being served with a copy. See 28 U.S.C. § 636(b)(1); FED. R. CIV. P. 72(B). In order to be specific, an objection must identify the specific finding or recommendation to which objection is made, state the basis for the objection, and specify the place in the magistrate judge's findings, conclusions, and recommendation where the disputed determination is found. an objection that merely incorporates by reference or refers to the briefing before the magistrate judge is not specific or sufficient. failure to file written objections will bar the aggrieved party from appealing the factual findings and legal conclusions of the magistrate judge that are accepted or adopted by the district court, except on grounds of plain error. See Douglass v. United Services Auto. Ass'n, 79 F.3d 1415, 1417 (5th Cir. 1996).
