ORDER

The State's brief was filed on November 8, 2016, and Appellant's reply brief was due on November 28, 2016. See TEX. R. APP. P. 38.6(c). However, Appellant advised this court that he did not receive the State's brief until December 14, 2016. The next day, Appellant filed a motion for an extension of time to file the reply brief until January 3, 2017.

Appellant's motion is GRANTED. See id. R. 38.6(d). Appellant's reply brief must be filed in this court by January 3, 2017. See id. R. 38.3 (authorizing an "appellate court [to] consider and decide the case before a reply brief is filed").
