ORDER

The State of Texas's brief was due to be filed in this appeal on or before September 16, 2016. On September 16, 2016, this Court notified the State that neither the brief nor a motion for extension of time has been filed. For this reason, this Court ordered the State to file its brief on or before October 3, 2016, and cautioned that if the brief is not filed by this date, the case may be submitted without the State's brief. As of this date, the State has not filed a motion for extension of time or a brief.

It is therefore ORDERED this case is set at issue and will proceed without the State's brief.
