HENRY LEE CAREY, Appellant v. THE STATE OF TEXAS, Appellee
On Appeal from the Criminal District Court No. 1 Dallas County, Texas Trial Court Cause No. F19-55133-H & F19-10416-H
ORDER
ROBERT D. BURNS, III, CHIEF JUSTICE
The clerk's records in the above appeals were filed August 5, 2021. On August 19, 2021, appellant filed a "motion to supplement the record on appeal and hold briefing schedule in abeyance." In the motion, appellant notes the documents entitled "Notice of State's Intention to Enhance the Range of Punishment" filed in each case appear in the clerk's records "without a file stamp and with an incomplete style-of-the-case header."
On August 25, 2021, the district clerk filed a request for an extension of time to research the issues raised in appellant's motion and file supplemental clerk's records. We GRANT the request and ORDER the supplemental clerk's records filed within TWENTY DAYS of the date of this order.
We will defer ruling on appellant's motion until either supplemental clerk's records are filed or the district clerk files written verification that the documents appellant seeks to have filed in the supplemental record do not exist.
We DIRECT the Clerk to send copies of this order to the Honorable Tina Clinton, Presiding Judge, Criminal District Court No. 1; Dallas County District Clerk Felicia Pitre; and counsel for all parties.
