On August 8, 2011, the Court issued a Report and Recommendation [Docket No. 198] regarding disposition of Defendants' Motions to Dismiss [Docket Nos. 128, 135, 137, 141 & 142]. Accordingly,

IT IS HEREBY ORDERED that the Motion is DENIED as moot.
