Petitioner-appellant having moved to vacate the dismissal of petitioner-appellant's appeal taken herein from an order of the Onondaga Surrogate's Court entered in the Office of the Clerk of said court on April 12, 2011,

Now, upon reading and filing the affirmation of Kevin G. Roe, Esq., dated September 16, 2011, the affidavit of Lamise Carano sworn to September 14, 2011, the notice of motion with proof of service thereof, and the affidavit of James N. Seeley, Esq., sworn to September 29, 2011, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, on the condition that petitioner-appellant perfects the appeal on or before December 5, 2011.
