ORDER

On order of the Court, the motion to file a brief amicus curiae in support of the application for leave to appeal is considered, and the motion is GRANTED. The application for leave to appeal is also considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REVERSE the judgment of the Court of Appeals, 173 Mich.App. 167, 433 N.W.2d 389, and REMAND this case to the trial court for further proceedings because there are factual issues which make summary disposition in favor of either party inappropriate.

We do not retain jurisdiction.
