ORDER


The case comes before the court on the plaintiff's motion to require the defendants' production of their counsels' billing records in this case. (Dk. 150). The defendants oppose the motion. (Dk. 154). Considering the arguments made and authorities cited by both sides, the court denies the plaintiff's motion without prejudice to the plaintiff requesting reconsideration after the defendants have filed their brief in response to the plaintiff's fee application. A request for reconsideration shall be filed no later than ten days after the defendant's brief and shall include a particularized showing of need.

IT IS THEREFORE ORDERED that the plaintiff's motion to require defendants' production of time and cost records (Dk. 150) is denied without prejudice to the plaintiff seeking reconsideration on the conditions stated above.
